One of the most common questions we receive at the Law Office of Mike Campbell is how our attorney’s fees are handled. Personal injury attorneys handle fees differently than most other types of lawyers. This blog contains answers to some of the questions we receive about our fees and the costs of filing a personal injury claim at our firm.
Note: Keep in mind that this blog is written from the perspective of our attorneys. Other personal injury firms may handle fees differently than noted below.
For all personal injury cases, our attorneys work on a “contingency fee.” A contingency fee means that our fees are contingent (or depend) on our firm obtaining a recovery in your case. As a result, you will not receive an hourly bill from us for your case as we work and you will never owe us anything if we do not recover anything for you.
In nearly all car accident, premises liability, and medical malpractice cases, our fee is 33.33% of any recovery we get for you if we able to settle your case without having to file a lawsuit. If we have to file suit, our fee is 40% due to the increased amount of work involved with both preparing for and trying your case. Again, you will not ever receive a bill from our office if we are unable to recover anything for you. That means if we go to trial and do not recover anything, you do not owe us anything.
Additionally, our firm will cover all expenses associated with the prosecution of your case. That means you do not have to worry about costs for depositions, court fees, or other expenses that are incurred during the normal course of prosecuting a personal injury case. While we give all of our clients the option to pay for these expenses themselves, we offer this service to all of our personal injury clients and only ask for those expenses to be repaid if we are successful in recovering you anything.
What does this mean for you? You do not owe us anything up front and do not owe us attorney fees or expenses we pay associated with your case if we do not recover anything for you. If we do recover you compensation for your injury, the fee is based upon where we are at in your case. We also are reimbursed for any expenses the firm incurs on behalf of the case, which include court costs (depositions and filing fees) and expert fees (to help support your case).
